1. About Xelarate

1. About Xelarate

Xelarate provides online tutoring services that connect secondary-school students with tutors for focused, one-on-one educational assistance. Xelarate is designed for students in Years 7–12, with a particular focus on HSC support. Tutoring may be requested for immediate assistance during Xelarate’s operating hours. Requests for tutoring at a later time may also be considered when made directly to Xelarate, subject to tutor availability.

2. Tutor availability and matching

2. Tutor availability and matching

Xelarate will make reasonable efforts to identify a tutor suited to the student’s year level, subject and requested area of assistance. Tutor availability depends on factors including subject, year level, time, demand and individual tutor availability. Xelarate does not guarantee that a suitable tutor will always be available. If Xelarate cannot find a suitable available tutor for a paid request, the student will receive a full refund to the original payment method in accordance with our Refunds & Cancellations Policy.

Operating hours refer to the period during which immediate tutoring requests may be submitted. A session accepted during operating hours may continue beyond the stated closing time, provided an available tutor has agreed to complete the full session length.

3. Educational assistance and outcomes

3. Educational assistance and outcomes

Xelarate tutoring is intended to support a student’s learning, understanding and problem-solving. Xelarate does not guarantee any particular mark, grade, ATAR, examination result, admission outcome or other academic achievement. The amount of progress that can be made during a session may depend on factors including the complexity of the material, the student’s existing knowledge, preparation, participation and the amount of tutoring time purchased.

4. Academic integrity

4. Academic integrity

Xelarate is intended to help students understand academic material and develop their own knowledge and skills. Students must not use Xelarate to facilitate cheating, academic misconduct or the dishonest submission of work completed by another person.

A tutor may decline to complete work on behalf of a student where doing so would be inappropriate or inconsistent with applicable academic-integrity requirements. Students remain responsible for ensuring that work they submit to a school, institution or assessment authority complies with the relevant rules and requirements.

5. Session lengths and pricing

Xelarate currently offers the following starting session lengths: 20 minutes — $25; 40 minutes — $45; and 60 minutes — $60. All prices are in Australian dollars unless otherwise stated.

If additional tutoring time is requested during a session, an extension may be purchased at the price shown through the extension payment link provided by Xelarate. Extensions are subject to tutor availability, successful payment and confirmation from Xelarate.

Prices may change for future bookings. The price clearly displayed at the time of purchase applies to that transaction.

6. Payment

Payment must be successfully completed before Xelarate is required to provide the purchased tutoring service. Payments may be processed by a third-party payment provider such as Stripe. The person making the payment is responsible for ensuring that they are authorised to use the selected payment method.

7. Students under 18

Xelarate provides tutoring to secondary-school students, including students under 18. Parents and guardians may arrange and pay for tutoring on behalf of a student. Xelarate may apply additional safeguards, verification steps or participation requirements where reasonably appropriate for younger students or particular circumstances.

8. Online tutoring sessions

Tutoring sessions are delivered remotely through the Xelarate online classroom. Users are responsible for having a suitable device, compatible browser and stable internet connection.

Access details will be provided after a tutor has been confirmed. Students must use the classroom access provided for their assigned session and must not share it with anyone else.

9. Behaviour and safety

Students and tutors are expected to behave respectfully and appropriately. Xelarate may refuse, pause or end a session where there is abusive, threatening, discriminatory, sexually inappropriate, harassing or otherwise seriously inappropriate behaviour, or where continuing the session may create a safety concern. Xelarate may restrict future use of the service where reasonably necessary to protect students, tutors, staff or the service.

10. Uploaded materials

Students may upload questions, screenshots, notes, documents or other learning materials to help Xelarate understand the tutoring request. Users should only upload material that they are permitted to provide. Users retain ownership of material they submit. By submitting material to Xelarate, the user permits Xelarate and the tutor selected for the relevant session to use that material to the extent reasonably necessary to organise and provide the tutoring service.

11. Tutors

Tutors may have different educational backgrounds, experience, subject strengths and teaching styles. Xelarate aims to select tutors who are suitable for the service and relevant subject areas, but individual experiences may vary. Tutors are expected to provide educational assistance professionally, respectfully and in accordance with Xelarate’s applicable standards and safety requirements. Tutors are not authorised to make guarantees or commitments on behalf of Xelarate unless expressly approved by Xelarate.

12. Scheduled sessions

Xelarate may, at its discretion, arrange tutoring for a later date and time when requested directly by a student or parent. A requested time is not guaranteed until Xelarate confirms the booking. Availability depends on factors including the subject, requested time and available tutors. Changes, cancellations and refunds are governed by the Refunds & Cancellations Policy.

13. Preferred and repeat tutors

A student may request a tutor they have previously worked with. Xelarate may prioritise that tutor where reasonably possible, but preferred-tutor requests are subject to availability and are not guaranteed. If the requested tutor is unavailable, Xelarate may offer another suitable tutor.

14. Additional tutoring time

If the student and tutor wish to continue beyond the originally purchased session, additional tutoring time may be purchased only through an extension payment link provided by Xelarate.

An extension is confirmed only after payment has been received and Xelarate has confirmed that the tutor is available to continue. Additional tutoring time is not guaranteed.

15. Cancellations and refunds

Cancellations, missed sessions, technical issues and refund requests are governed by the Refunds & Cancellations Policy. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

16. Technical issues and service interruptions

The Xelarate online classroom and other technology used to provide the service may occasionally experience interruptions or technical issues.

If a technical issue materially affects a paid tutoring session and cannot be resolved promptly, Xelarate will consider the circumstances and provide an appropriate remedy, which may include rescheduling, a credit or a refund, in accordance with the Refunds & Cancellations Policy and Australian Consumer Law.

17. Website and service information

Xelarate aims to keep information about its services, operating hours, pricing and availability accurate and current. These details may change as the service develops. Where pricing or service information presented during a transaction differs from older promotional material, the information clearly presented and agreed to at the time of purchase will apply, subject to applicable law.

18. Liability and consumer rights

To the extent permitted by law, Xelarate is not responsible for loss arising solely from circumstances outside its reasonable control or from a user’s misuse of the service. Nothing in these Terms is intended to exclude, restrict or modify any liability, consumer guarantee, right or remedy where doing so would be unlawful.

19. Privacy

Xelarate handles personal information in accordance with its Privacy Policy.

20. Changes to these Terms

Xelarate may update these Terms as the service develops or where operational, legal or regulatory requirements change. Updated Terms take effect when published on this website and apply to future use of the service and future purchases. They do not change the Terms that applied to a previously completed purchase. The latest update date will be displayed at the top of this page.

21. Governing law

These Terms are governed by the laws of New South Wales, Australia. Subject to any rights that cannot lawfully be excluded, the parties submit to the courts of New South Wales and any courts entitled to hear appeals from them.
